Hi, my name is Cary Jones, and I'm an attorney serving the greater Austin area. After graduating from Southern Methodist University in Dallas I entered the University of Texas Law School. Upon graduation I worked as the public defender for the Travis County Juvenile Court until I entered private practice.

I am a member of the Austin Bar Association where I have twice served on the Board of Directors. I have served as chairman of the Travis County Lawyer Referral Service on two separate occasions. I am also a member of the State Bar Of Texas.

ADVICE FOR ACCIDENT VICTIMS

If you or someone in your family is injured in an accident, and you believe that a damage claim is appropriate, you should be aware of certain issues. First, in order to make a claim against another party, you must be able to prove that the other party was responsible for the injury. This involves proving that the allegedly responsible party, be it an individual, business or governmental entity, was as fault. This is done by proving negligence. To prove negligence one must first show that the other entity had a duty to the victim, and that this entity failed in meeting that duty. Thus it is important that as an accident victim you collect as much information as possible to support your claim. For example, witness information should be gathered promptly, and the location should be photographed. Objective witness statements are often the most critical piece of evidence in any claim, and a location will often be different when visited later. Obviously a competent attorney, when timely hired, will be the best way to insure the appropriate gathering of all necessary evidence.

Once negligence has been proven, the next issue to be addressed in any injury claim is damages. There are several different measures of damages. Some examples are past medical expenses, future medical expenses, lost wages, loss of wage earning capacity, pain and suffering, disfigurement and punitive damages. Contrary to popular belief, juries across the country have become very conservative in awarding damages. In many jurisdictions, average awards have decreased by as much as 75% over the past 10 years, and of course, insurance company offers have followed this trend. Therefore, it is extremely important that your damage claim be gathered and presented in a professional and knowledgeable manner. You can be assured your claim will be reviewed by the insurance company in a way that attempts to minimize your damages. Again, as with the presentation of your negligence argument, it is critical that you have competent legal advice when presenting your claim for damages.
